Our primary practice focuses on creating custom-tailored estate plans. For each client, we discuss planning options that include revocable trusts, irrevocable trusts, a will, a durable power of attorney, a health care proxy, and documents to address HIPAA concerns. Every client’s needs are different, so the focus of our planning is creating a web of documents that cover as many potential issues as we can, while maintaining for the client the maximum amount of flexibility possible.

A good estate plan provides peace of mind that during life you can maintain control of your assets as long as you are able. After you pass away, a good plan ensures that, to the extent possible, you can minimize the impact of both Federal and Massachusetts Estate Taxes, probate costs, and estate administration expenses, and pass your assets to those individuals you believe need them most.

Nursing Home, Long-Term Care & Medicaid Planning

In Massachusetts, nursing home costs can average more than $100,000 per year, and almost half of us will need long-term care at some point in our lives. We want to ensure that your estate plan accounts for the possibility that you or your spouse may need nursing home care, and provide a way to manage the costs associated with that care.

One of the most common methods of managing the costs of a nursing home is by using the Massachusetts Medicaid program, MassHealth, to pay for some or all of your care. However, the financial requirements for MassHealth are very strict, and the program offers innumerable ways to jeopardize eligibility. At Fay & Eberly, we can help you navigate the minefield that is the MassHealth application process and put you in the best position possible to qualify for Medicaid.

If a loved one passes away and you need assistance navigating the probate process, we are here to help. We regularly assist the Personal Representatives of an estate with the filing of probate documents, obtaining appraisals for the deceased’s assets, and filing the necessary accounting paperwork.

Not everyone who has been chosen as a Personal Representative has the time or experience necessary to devote to the task, and we are here to ease the burden — providing guidance, coordinating with financial institutions, and filing the myriad documents required by the Massachusetts Probate Courts to settle your loved one’s estate.

Massachusetts Trust Administration

  • Assisting Trustees with Creditors & Debtors of the Estate
  • Helping with the Process of Distribution

While trust administration is generally an easier and more streamlined process than probate, it still requires that the Trustee work to settle the deceased’s estate. Just as we can assist a Personal Representative through a probate, we can help a Trustee administer the trust he or she manages.

We can perform the “legwork” necessary to complete the duties spelled out in the trust document — arranging appraisals of the trust estate, determining whether the estate is taxable, arranging for estate tax returns to be filed if necessary, and completing inventories of the trust assets.

Jennifer Fay

Working as an estate and Medicaid planning attorney has always been near and dear to Attorney Fay’s heart. Her grandmother was diagnosed with Alzheimer’s at the early age of 57. As a child, Attorney Fay was unable to help her family through the emotional and financial complexities involved in estate and Medicaid planning. As the family was unprepared for such a situation, she watched as her grandmother and grandfather lost their hard-earned assets one month at a time during her grandmother’s 14-year stay in a nursing home. Her grandfather worked hard to care for his wife, but failed to take care of his health and died early, at age 63.

After watching the experience of her own family, Attorney Fay found her niche in estate and Medicaid planning, knowing she could do for others what she could not do for her own family. Today, Attorney Fay takes every opportunity to guide others through what can often be the most difficult time in their lives. Through community outreach and education, she hopes that fewer and fewer individuals will find themselves in such a difficult situation during their golden years.

Attorney Eberly has practiced only elder law since his admission to the Bar. His practice focuses on creating custom-tailored estate plans that allow individuals and families to minimize the negative impact of taxes, nursing home costs, and estate administration expenses. Attorney Eberly strives to give families the option to preserve their assets and care for their loved ones through all stages of their lives.

These areas of the law come with many pitfalls. Helping people avoid these pitfalls, and guiding their families through the toughest times they may face is why Attorney Eberly practices elder law.

At Fay & Eberly, we believe there is no “one-size-fits-all” approach to estate planning. Different people have unique needs, fears, and assets. Off-the-shelf planning does not take into account these varying factors, and it can result in a plan that does not address one or more of the many complicating factors that people face as they age.

Incapacity, health problems, long-term care, taxes, and estate administration expenses all need to be considered when designing a plan that suits your needs. Because our firm devotes all of its time to matters of estate and Medicaid planning, we have developed both a depth of knowledge in the area, and the ability to distill that information for our clients.

We listen to the concerns and issues that you have, and use them to build a plan that meets your individual needs. You should understand your estate plan, because you are ultimately the one who will live with it.
